Please read these Terms and Conditions carefully before using www.caravanRVcamping.com operated by Caravan Repair Centre. This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.caravanRVcamping.com

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.

1.0     Changes To This Agreement

     1.1 We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
     1.2 Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

3.0 Disclaimer

      3.1 Your use of the Site is at your sole risk. The Site is provided on an "as is" and "as available" basis. The Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

      3.2 Caravan RV Camping, its subsidiaries, affiliates, and its licensors do not warrant that

a)    the Site will function uninterrupted, secure or available at any particular time or location;

b)    any errors or defects will be corrected;

c)    the Site is free of viruses or other harmful components;

d)    the results of using the Site will meet your requirements.

4.0 Governing Law

      4.1 This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Queensland, Australia, without giving effect to any principles of conflicts of law.

5.0 Intellectual Property

      5.1 The Site and its original content, features and functionality are owned by Caravan RV Camping and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

6.0 Limitation Of Liability

      6.1 In no event shall Caravan RV Camping, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for damages, direct or consequential, resulting from your use of the Site, and you agree to defend, indemnify and hold us harmless from any claims, losses, liability costs and expenses, including but not limited to attorney's fees, arising from your violation of any third-party's rights.

7.0 Limited License

      7.1 Caravan RV Camping grants you a non-exclusive, non-transferable, limited license to use the Site in accordance with this Agreement.

8.0 Links To Other Sites

     8.1 Our Site may contain links to third-party sites that are not owned or controlled by Caravan RV Camping. Caravan RV Camping has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

9.0 Return Terms

9.1 Items cannot be returned if they are opened, unless there is a manufacturer defect.
     9.1.1 Merchandise that has been opened, attempted to be installed, used, or altered will not be accepted for return or exchange.
     9.1.2 You must return the item/s within 14 days of your purchase.
9.2 Change of Mind Returns
     9.2.1 Please choose carefully as we do not provide a refund for where you:
a) have simply changed your mind
b) have made a wrong selection
c) have found the goods elsewhere
     9.2.2 If in the instance that any (but not limited to) the above occurs, we are able to offer an exchange or a store credit, less shipping and a re-stocking fee of 10% of the affected item/s. Goods are returned at the customers expense.
     9.2.3 Please contact us via our resolution centre before sending any items back.
9.3 Received Incorrect Items: If the item you receive is different to the item you have ordered, contact us via our resolution centre  on our website within 2 business days of receiving your order. We will organise for a return authorisation and the correct items to be sent to you.
9.4 Damaged Goods Returns
          9.4.1 Damaged In Transit: If you receive goods which you believe were damaged during delivery:
     a) When signing for your delivery, make a note on the comments section of the con note.
     b) Take photographs of any damage to packaging or product.
     c) Contact us via our resolution centre on our website within 2 business days of receiving the order for further instructions.
     d) Generally, we will organise for a return authorisation and replacement item/s to be sent to you.
9.4.2 For products damaged upon opening, use instructions for warranty, see section 12.1.

 

10.0 Shipping

10.1 We use a variety of couriers depending on the product and your location to ensure that we can get your order to you promptly.  However, our preferred courier is TNT.
10.2 Delivery Times: Delivery can vary depending on the product and your location.
10.2.1 For Metro Areas, allow 2-3 business days. For all other areas, allow 7-10 business days.
10.2.2 Please note, these are estimate delivery times only.  Due to circumstances beyond our control, delivery may be delayed past these standard delivery estimates. We shall not be liable for any loss or damage incurred due to failure of the order (or any part of it) to be delivered promptly or at all.
10.3 Tracking Your Order: You can get tracking information by logging into your account on our website.
10.4 Missing During Transit: If you believe your item is missing in transit:
     a) Have you done a track and trace?
     b) Contact us via our resolution centre for item/s not received.
     c) We will lodge an investigation with the courier.
     d) As verifiable by the courier, if the delivery cannot be located, we will organise for a replacement order to be sent to you.
10.5 Missing Items: If you receive your order and are missing any items, please contact us via the resolution centre on our website within two business days so that we can rectify the missing item for you.
10.6 Incorrect Address: If you have supplied us with an incorrect delivery address, please advise us as soon as possible. If your order has not yet been dispatched, we will endeavour to change the address for you.  If your order has been dispatched, additional charges will be incurred for the re-delivery to the updated address.
10.7 Re-Delivery: If you are not home at the time the courier tries to make a delivery and you have not requested for your items to be left unattended, they should leave a card with contact details.  It is your responsibility to make the arrangements for a re-delivery or to pick up from the depot.  Any charges incurred in a re-delivery will be at your expense.
10.8 Unattended Delivery: If you request for any or part of the order to be left outside a premises or to an unattended location, then the delivery is done so solely at your own risk. We do not take any responsibility or liability for any damage or loss to items once they have been registered by the courier as being delivered.

 

11.0 Termination

11.1 We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

 

12.0 Warranty

12.1 If you believe that your product has a manufacturers defect:
     a) Take photos of any visible damage where possible.
     b) DO NOT return any items back to us without contacting us first.
     c) Contact us through our resolution centre on our website.
     d) Await further instructions from us.
12.1.1 Items generally need to be assessed by a certified service agent.  If it is found by the manufacturer or the service agent to be a manufacturers defect, it is with the manufacturer that the next course of action is decided.
12.1.2 If it is deemed not a manufacturers defect, any costs incurred is at your expense, including return freight of your items.

Your rights under the Australian Consumer Law The following is a summary of your rights under the Australian Consumer Law. For further information please consult the ACCC website at: accc.gov.au .

12.2.1 Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Under the Australian Consumer Law, your rights commence and continue for a “reasonable period” from the date you purchased the Product

What is a “reasonable period “will depend upon all of the relevant circumstances, including the price, the uses to which it has been put and the nature of the Product.

In addition, you may also be entitled to have the Product repaired or perhaps replaced under the terms of any Manufacturer’s Warranty relating to your Product. Information on the Manufacturer’s Warranty is contained in the Product packaging.
